Alright so we go to WalMart yesterday for what was supposed to be an "get in and get out kind of deal" and when we walk over to our car, there's a shopping cart laying on it's side and this huge dent in our Honda Civic. The car is only a year old and Jim about had a heart attack as did I. So I walked (more like ran) back inside and called the police.
Now wouldn't you know it, the guy who we think hit the cart into our car (his car was still there) acted like an A$$. First they called in his license number and got his name so they could page him on the intercom in the store. The guy wouldn't come to the page so the officer had to wait until he saw him go to the car. Then the guy was all snotty and wouldn't give the cop any information. Wouldn't hand over his driver's license, wouldn't fill out any forms. Just threw a big fit (while the two young woman who were with him were laughing the entire time about the whole thing). Then the guy left. The officer told him if he pulled the surveilance tapes and had proof that the guy is the one who rammed the cart into our car, he would come arrest him. So that's alright but can you believe the officer let the guy leave without any info or anything. I don't even know if the guy has insurance or not. This would not have happened in Ohio, that's for sure. They would have arrested that guy right then and there for refusing to co-operate. I'm starting to hate this town, everything is so darn slow here and people don't want to do their job. You know I went to pay the gas bill once and there was a sign on the gas company's front door that said someone called off today so we'll be back in about 2 hours. Can you believe that?
So anyway, I don't know what's going on. Can't get a hold of the police officer who did the report yesterday either. called the police station and they said he's off until Thursday. My question is "What the heck is the matter with this town"

I'm sorry that such a thing happened. I know what you're feeling about stuff like this, it's really frustrating. Hope you get things straightened out.

Hey Flo, I know how you feel. Had a guy swing open his door hard and leave a big dent in the side of my truck, while I was in it! When I confronted him he just laughed and said "tough shit" and went into the store. I'm sure he got another good laugh when he came back out and found the imprint of my 2 inch high cowboy boot heel in his fender. I never bother with the cops, because I've never had one do anything worthwhile in my life.

well, it wouldn't have done any good to put a dent in this guy's car as he had dents all over to begin with. I was hoping that they would find the tape of it so he would get arrested because he was being so darn smart and thought the whole thing was funny. I'm kinda afraid now though because he was all hostile and took down our license plate number. What if the guy is some gang dude or something. There's alot of that around here. Jim even took the big garden shovel out of the car in case someone shows up at our door and starts something. It's not against the law to lay someone out literally here if they come on your property. The whole thing is freaky and then the insurance guy asks me if I want him to take out the deductable and they pay the rest. I told him I'm not paying for it. We didn't do it. They either go after the guy or go after WalMart because they can't pick up their shopping carts. I'm not paying for this damage, no way. Oh yeah, here's the kicker. When I walked back into WalMart with nothing but my purse on me, the greeter guy was standing at the security things (the alarms) cuz the alarm had went off on something some woman bought. He stood so close while he was scanning it that he set the alarm off just as I was walking "into" the store and he stopped me. Made me stand there for almost 10 minutes until he was done to check me. Can you believe that? So I said "Watch me!" and I walked back and forth through the security and the thing never went off once. I told him he set it off himself. I told him I really didn't need that at that time. The car got hit, I went in to call the police, went back in to see if the manager was on his way out yet or not when I got stopped for the alarm. When I got to the service desk finally she told me the manager already walked out so he walked passed me when I got stopped for supposedly stealing from the store on my way into the darn store. These people here are nuts!!!!! I think all the idiots and lazy people in the world got sent to Alamogordo Don't get me wrong, there's nice ones here too that try to work hard but those other morons make it he!! for everyone else

Sorry to hear about your car Flo and the lousy day you had! I didn't know you could refuse to show id when asked by a cop! If I tried it I would probablly end up in jail, never been there and don't want to start now so I just hand it over, easier all around. Hope they got the jerk on tape for you and I'm sure the cop's got his lisence number., it's nice to see people like that get their's.

i hope you have good luck with the situation. our whole police dept would have surrounded him. you wouldn't have gotten any help with the car but that fellow would have had to give up the id and the girls.

yeah well, have to wait until Thursday until the officer comes back on duty to find out anything It's just so darn frustrating. In Ohio they would have arrested him too for refusing to give an officer his information when asked. I mean the police pretty much let the guy leave a scene of crime

I've worked at a law enforcement agency for the past 26yrs and still do. These kind of incidents happen alot. Someone must have seen this happen in a busy Walmart parking lot! It would have been nice if the witness would step up to the plate and leave their personal info on your windshield! People just don't want to get involved which is sad. Pulling the tape is fine, providing there was a tape in it and it was working properly at the time. The problem is the officer can't do alot in this situation without proof and/or a witness. In our city that guy wouldn't have gotten away with acting in that manner. He would have been cuffed and stuffed and charged with Interfering! Hopefully, the officer did get his lic plate number. Alot of the time people don't drive their own vehicles, nor do they have a driver's license or insurance. If I were you I would put an add in the newspaper, asking for any witness who saw this incident take place on that day in their parking lot. As it sounds as tho the guy is a jerk and not going to admit guilt! With the girls laughing about it, I'm sure they could care less, unless it was their vehicle. Once I got his personal info, and some car damage estimates, you can bet I would be taking him to small claims court! Sometimes, you have to be your own advocate when it comes to justice! I know, I work there and see this happen alot. Sorry, to hear about it tho as I would be ticked off big time with a new car!

A shopping cart did 984$ damage? Ouch! indeed. I hope it works out. I am sorry that happened. It took me a long time to teach my wife to park way in the back of the parking lot. She is from Los Angeles and the first spot to the front door is the only way to park. Not a ding since. Walmart is unpleasant, that makes it much more so. When we lived in Punta Gorda, the Walmart in Port Charlotte, we were crossing in the pedestrian walk and a good ole boy in a Camaro tried to run us over. He came from no where, gunned the engine, and deliberately ran to us in his auto right up to the store wall. Definately ouch on that fender. That sucks.

"cuffed and stuffed"....gotta love it. it doesn't matter where you park, Doc. i had my brand new truck 2 days when i took my mother to the mall, dropped her off, parked waaaaaaaaaay out in the back 40 and hoofed it back to the mall. when i went to get the truck, somebody in an old beater took the time to park right next to me to inflict the first "door ding" i was flabbergasted that someone would park way out in the back lot to deliberately trash a new vehicle. but they are out there, twisted small souls that want to make the world (and everyone in it) pay for their own percieved injustice.
i thought these days, Walmart had better security cameras doing the vigilant routine. it may take a lawyer to get those tapes or your insurance company may try and lean on them (Walmart), but Walmart is like Big Kahuna Electrical Daddy, you are beating your head upside a brick wall trying to fight them.
still as they say in the UK, "in for a penny, in for a pound", if you want to fight it, dig in and try and use your insurance company to work with you. it ain't easy.
good luck,
KD

I remember grocery shopping and this woman looks on as her cart flies across the lot towards a car - she says "my cart!" but doesn't try to stop it - just looks at it picking up speed to hit a fender. My husband always/ALWAYS parks next to the cart return spot - always. It's like he's asking for trouble.... There's a reason they're always available!!!

well still haven't heard anything from the police officer on that report so will wait until Jim gets home from work and guess call the police department or go down there to get the report. It's just frustrating. And yes, in Ohio, he would have gotten "cuffed and stuffed" too for acting that way. But I guess I have to live with the fact that I live here in Alamogordo NM now and things are different here. Oh are they different!!!
