I won the bid on a nice Harley shirt. They sent me an invoice today for a total of $10.99. I go and look at the item and it says they are not registered with ebay, anymore. I did the live chat with customer service tonight and they told me that ebay pulled their account. Ebay says if I pay and don't get the shirt, there is nothing they can do to help me. If the user gets reinstated they can leave me negative feedback for non payment and I will have to contact ebay to get it removed, but you will still be able to see that a feedback was withdrawn. The seller emailed me and said I Will get my shirt, they promise. The seller also has 3 feedbacks in the last month for buyers not getting their items. Should I take a chance and pay them or take the chance they will re-register and leave me a negative? We have 100% now with 321 positive feedbacks. cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=190125442772

My opinion is that you intended to purchase something from them through Ebay and they are no longer a part of Ebay. If they can get reinstated then maybe finish the deal but not till then. Maybe send them an email explaining this position. Their feedback shows that something is going on and deserved the boot. I see one case where they, by intent, didn't uphold their obligation to a customer.

"A fool and his money are easily parted"...don't be a fool.
I'm with Rocky G. You made a bid on an ebay item, through and ebay auction run by an ebay seller under ebay rules. They are no loneger with ebay and no longer under ebay's rules. Now you would just be buying from "some guy" who is running by his own set of rules. Plus, THEY were ditched by ebay...that's got to set off the alarm bells.
That's my take.

Earthdog,
I'm sure you entered into the bidding in good faith and would gladly pay for the Harley shirt if the deal was on the up and up but obviously this seller is having BIG problems right now. I would hold off paying for the shirt based on eBay's own declaration:
"In addition, we don't recommend sending payment to a seller if they are not a registered user."
I think it is a good idea to send an email to the seller explaining your decision to hold payment until they are re-instated. If they should leave a negative feedback about you in the future you will also be able to state your own feedback and have theirs withdrawn.
I read many of the feedback comments left for missmitzy49...she's not been doing so well of late and doesn't seem to remember the first rule of good customer relations: The customer is always right! Calling a buyer an "IDIOT" makes the seller pretty idiotish herself.

Yep, pass on this one. If they get re-instated I doubt they would give a neg. anyway, since you could just give them one right back, and they are the ones who would be really vulnerable to getting bad feedback at that point. Even if they did give you bad feedback, your rating would still be something like 99.7%, and I don't think anyone would be too worried about that.
Send them an email and explain your position and say that you hope to see them back on ebay soon, that's all. -Don

That's what I was trying to tell him last night, but of course, wife's opinions don't count! I told him to email them back and state you'll pay them once they again become a legit ebayer......I also told him to quite buying shirts and hats on ebay, those sellers don't seem to be as honest as the ebayers that sell rocks!

What about asking the seller to send you the shirt first then you can send him payment? If he's that honest, he should go along with it. If not, then you can rip him in the feedback section just the same.

Condor's got it right.
Tell the 'outlaw' seller "Look, my feedback's better than yours, in fact, it's perfect. So you know I've never failed to pay. When I get the t-shirt I'll pay you right away." If they don't want to ship first, walk. They're the one with their ass in a sling.
Every buyer on every eBay auction (about 170 billion times to date) has put their money up front, expecting good faith (and the item) from complete strangers, for the most part. This seller has no right to expect that same good faith.
